If I’m a buyer, do I have to pay my agent’s commission
It depends. Many sellers here in Florida have already agreed to pay all, or a portion, of a buyer’s agent compensation. Your real estate agent should know if the seller is offering compensation before you view the house.
Do I have to sign a contract with a buyer’s agent before seeing houses?
As of August 17, 2024, you will need to sign a written Buyer Agreement before touring a property. This agreement should explain what services the agent will provide. The agreement should also detail the amount of compensation the buyer’s agent will expect to receive if you decide to purchase the home. This agreement cannot be open-ended and must have a specific compensation amount listed. Your agent cannot be paid MORE than reflected on the Agreement but they may agree to receive less in certain circumstances.
Can I request the seller pay my agent’s commission even if the seller indicates no buyer compensation is offered?
Yes, commissions are fully negotiable — you can make the request that the seller pay your agent compensation as part of your offer on the house.
Can I include my agent’s compensation as a closing cost in my mortgage?
You’ll need to ask your lender this question, but doing this will likely change the terms of your loan.
How long is my written agreement in place with my agent?
That depends. Your agent ultimately wants to help you find the perfect property. Your agreement could be for a short time period or several months. It’s negotiable.
What if I decide I don’t want to work with my agent anymore?
You’ll need to notify your agent in writing and then abide by the terms of your Agreement. Some agents require a retainer, which you may not get back if you decide not to work with them. Read your agreement carefully.
